Washington State Criminal Record Laws

Washington's criminal records system is governed by RCW 10.97, the Criminal Records Privacy Act. This law defines conviction data, sets rules for who can access non-conviction records, and establishes the framework for background checks in the state. Felony convictions are public. Non-conviction data, including arrests that did not lead to charges, dismissals, and acquittals, is restricted. You will not find non-conviction information in a WATCH report or on the public court portal unless the record was sealed or the case was dismissed in a way that kept records open.

Under RCW 9.94A.640, some people qualify to have felony convictions vacated after completing their sentence. Once a judge grants vacation, the record is treated as if the conviction did not happen. It will not show up in WATCH results, though court case files may still exist in physical form at the clerk's office. Knowing this helps explain why some expected records appear to be missing.
